CMA supports Morgentaler’s India trip

Henry Morgentaler was invited to give a lecture at a conference on law and medicine sponsored by the Indian Supreme Court and the Indian Medical Association in the second week of February, 1985. Canadian co-sponsors of Morgentaler’s trip were the Canadian Medical Association and the British Columbia Medical Association.

Canadian Civil Liberties

The Candaian Civil Liberties Association (CCLA) has called on Ontario’s new Attorney-General, Mr. Robert Welch, to compensate Henry Morgentaler for his legal expenses in the Crown’s appeal, reported the Globe and Toronto Star on February 11, 1985. In a letter to Mr. Welch, Alan Borovoy, general counsel of the CCLA, says Dr. Morgentaler’s case puts him in a situation similar to those of nurse Susan Nelles and Donald Marshall.

In his letter Mr. Borovoy states: “Very few individuals in our society have the financial resources to engage in perpetual legal conflict with the Government…. When the Crown chooses to appeal against an acquittal, it is in the position of being able financially to break the accused.”

On several occasions in the past, Alan Borovoy and the CCLA have intervened on behalf of Morgentaler.
